Welcome to GyftPro! These Terms & Conditions ("Terms") govern your access to and use of the GyftPro mobile application, web portal, and related services (collectively, the "App"). By accessing or using the App, you agree to be bound by these Terms.
If you do not agree to these Terms, please discontinue use of the App immediately.
You must be at least 13 years old to use the App. If you are between 13 and 18, you represent that you have permission from a parent or guardian who agrees to these Terms on your behalf.
By creating an account, you certify that you have the legal capacity to enter into a binding agreement and that all information you provide is accurate and complete.
To access certain features, you must create a GyftPro account. You agree to keep your login credentials confidential and to notify us immediately of any unauthorized use of your account.
You are responsible for all activity that occurs under your account.
You agree not to misuse the App or engage in any activity that disrupts, damages, or interferes with our services. Prohibited behavior includes attempting to hack, reverse engineer, or gain unauthorized access to the App or any associated systems.
You also agree not to use the App to harass, defame, or impersonate others, or to upload content that violates any applicable laws or third-party rights.
The App may link to third-party products or storefronts. GyftPro does not control these external sites and is not responsible for their content, policies, or actions. Purchases and interactions on third-party platforms are solely between you and the external provider.
GyftPro retains all right, title, and interest in the App, including trademarks, logos, text, design, and software. You may not copy, distribute, modify, or create derivative works based on the App or any part of it without our express written permission.
By submitting ideas, wishlists, profiles, or feedback via the App, you grant GyftPro a worldwide, non-exclusive, royalty-free license to use, display, and improve upon that content solely to provide and enhance our gifting services. You represent that you have the right to share any content you submit.
Certain features may be offered through subscription plans or one-time purchases. All payment processing is handled through our PCI-compliant partners, such as Stripe. Fees are non-refundable unless otherwise stated, except where required by law.
If a subscription renews automatically, you may cancel at any time prior to the next billing cycle through your account settings or by contacting support.
GyftPro may offer virtual credits ("GyftCoins") or other promotional rewards. GyftCoins have no cash value and can only be redeemed within the App as described in the applicable offer. We reserve the right to modify, suspend, or terminate GyftCoins programs at any time.
We may suspend or terminate your access to the App if you violate these Terms or engage in fraudulent or abusive behavior. You may also terminate your account at any time by contacting support. Upon termination, your license to use the App ends immediately.
The App is provided "as is" without warranties of any kind, expressed or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, error-free, or secure use of the App.
To the maximum extent permitted by law, GyftPro and its affiliates are not liable for any indirect, incidental, consequential, or punitive damages, or for any loss of profits or data arising from your use of the App.
In all cases, GyftPro’s total liability for any claims related to the App is limited to the amount you paid (if any) for accessing premium features during the twelve months preceding the claim.
You agree to indemnify and hold harmless GyftPro and its officers, employees, and partners from any claims, damages, losses, or expenses arising out of your violation of these Terms or your misuse of the App.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes arising from these Terms or the App will be resolved in the state or federal courts located in San Francisco County, California.
We may update these Terms to reflect changes in law, technology, or our services. When we make changes, we will update the Effective Date and, where appropriate, notify you via the App or email. Continued use of the App after changes take effect signifies your acceptance of the revised Terms.
